SpotMe Workout Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of SpotMe Workout (“SpotMe Workout,” “we,” “our,” or “us”), a fitness partner-matching app for adults. By creating an account or using SpotMe Workout, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use SpotMe Workout.

2. Eligibility

• You must be at least 18 years old to use SpotMe Workout.
• You must provide accurate account and profile information.
• You are responsible for keeping your account secure and for activity on your account.
• You may not use SpotMe Workout if we previously removed or suspended your account for safety, fraud, or policy reasons.

3. Your Profile and User Content

You are responsible for the profile information, photos, prompts, messages, reports, session details, and other content you submit (“User Content”).

You grant SpotMe Workout a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and use your User Content as needed to operate, improve, promote, secure, and moderate the app.

You represent that you have the rights needed to share your User Content and that it does not violate another person’s rights or these Terms.

4. Safety and Acceptable Use

SpotMe Workout helps users connect for workouts, but we do not guarantee any user’s identity, behavior, skill level, health status, availability, or intentions. Use good judgment when meeting someone in person.

You agree not to:

• Harass, threaten, abuse, impersonate, or exploit another person.
• Post sexual, hateful, violent, illegal, deceptive, or harmful content.
• Upload content you do not have permission to use.
• Use SpotMe Workout for spam, scams, solicitation, commercial promotion, or unauthorized advertising.
• Attempt to bypass blocks, moderation decisions, technical limits, or security measures.
• Collect, scrape, or misuse other users’ information.
• Use SpotMe Workout in a way that violates law or another person’s rights.

5. Reporting, Blocking, and Moderation

You can report profiles, photos, and messages, and you can block users. We may review reports, user content, account activity, and related context to enforce these Terms and protect users.

We may remove content, hide profiles, limit features, suspend accounts, terminate accounts, or take other action at our discretion. We may not always notify you before taking action, especially where safety, privacy, legal, or security concerns are involved.

6. Fitness and In-Person Activities

SpotMe Workout is not medical, fitness, safety, or professional advice. You are responsible for deciding whether a workout, gym, location, partner, or activity is appropriate for you.

Consult a medical professional before beginning or changing an exercise routine, especially if you have health concerns. You are responsible for your own safety during workouts and in-person meetings.

7. Subscriptions and Purchases

SpotMe Workout may offer paid features or subscriptions through Apple App Store or Google Play. Prices, billing periods, renewal terms, cancellation rights, refunds, and payment processing are handled by the applicable app store and shown at purchase.

Subscriptions may renew automatically unless cancelled through your app store account before renewal. We do not receive or store your full payment card details. RevenueCat helps us manage subscription status and entitlements.

Except where required by law or app store rules, purchases are non-refundable. Requests for refunds should be made through Apple or Google as applicable.

8. Account Deletion

You may delete your account in Settings. Account deletion removes your active profile and related account data where reasonably possible. Some records may be retained for limited periods for legal, security, fraud-prevention, accounting, backup, or moderation reasons as described in our Privacy Policy.

9. Our Service

We may change, suspend, or discontinue parts of SpotMe Workout at any time. We may also update these Terms. If changes are material, we may provide notice in the app or by other reasonable means. Continued use of SpotMe Workout after changes means you accept the updated Terms.

10. Intellectual Property

SpotMe Workout, including our app design, branding, software, and content we provide, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you ownership of SpotMe Workout or our intellectual property.

11. Disclaimers

SpotMe Workout is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and safety.

We do not guarantee that you will find a workout partner, that matches will be compatible, or that interactions with other users will be safe or satisfactory.

12. Limitation of Liability

To the fullest extent permitted by law, SpotMe Workout and its owners, operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, property damage, or user conduct arising from your use of SpotMe Workout.

13. Termination

You may stop using SpotMe Workout at any time. We may suspend or terminate your access if we believe you violated these Terms, created risk for users, infringed rights, misused the app, or if required by law.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where local law requires otherwise.
